What is a trademark?

A trademark is your brand identifier that distinguishes you from your competitors in the marketplace and is memorable to customers, increasing brand awareness. It must be registered separately for each country in which your product is sold.

International Classification of Goods and Services (ICGS)

The International Classification of Goods and Services (ICGS) exists, with a total of 34 classes of goods and 11 classes of services. To successfully register a trademark, you must correctly select one or more classes that match your product. The number of ICGS classes affects the final cost of the state fee.

What is the validity period of a trademark?

A trademark is valid for 10 years after receiving the certificate. The right to use the trademark can be renewed an unlimited number of times for the same period.

Who can own a trademark in the Russian Federation?

Commercial and non-commercial legal entities, individual entrepreneurs, self-employed individuals, both residents and representatives of other countries.

What happens if I receive but do not use a trademark?

If a trademark is not used for three years, its legal protection will cease.

How long does the trademark registration procedure take?

The timeframe for examining a declared trademark is not established by Russian law. In practice, the examination typically takes 6-8 months, but can take more than a year. Taking into account the preliminary formal examination, which lasts up to 1 month, the total time from filing an application to receiving a certificate averages 10 months.

What cannot be registered as a trademark?

The list of restrictions leading to refusal is quite extensive:

1. Designations that have become generally accepted: linoleum, nylon, thermos, etc. The name of an item or service in essence: bread, chocolate, glasses, browser, surfing, etc.
2. Generally accepted symbols: red cross, diode icon, radiation sign, etc.
3. Names of cultural objects recognized by the state as cultural heritage of the Russian Federation
4. Names or pseudonyms of famous people, characters, works that are objects of copyright
5. National state symbols: flag, coat of arms, anthem, order, medal, as well as symbols of international organizations
6. Words and logos that may directly or indirectly violate the legislation of the Russian Federation (propaganda of the use of prohibited substances, (insulting religious feelings, obscene language, etc.)
7. Abbreviations

Is it possible to buy a ready-made trademark?

Yes, you can acquire a valid trademark through an assignment agreement from the copyright holder. The transfer of rights must be formalized with Rospatent; the fee is 15,000 rubles for one trademark and 13,000 rubles for each subsequent trademark in the same agreement.
